1. Introduction and Acceptance
Welcome to RideSafe ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the RideSafe mobile application, website, and related services (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting the updated version.
2. Service Description
RideSafe is a community ridesharing service that connects passengers and drivers for intercity travel, with a focus on user verification. The Service includes:
- matching passengers and drivers with similar routes
- facilitating communication between users
- subscription purchase and management
- safety features and verification
- reviews and ratings
RideSafe is an intermediary platform. We do not provide transportation services directly and are not a transportation carrier.
3. User Accounts and Responsibilities
3.1. Account Creation
To use our Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3.2. Age Requirements
The Service is intended for individuals aged 18 years and older. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
3.3. Driver Requirements
Drivers must have a valid driver's license, appropriate insurance, and a vehicle in good technical condition. Before offering rides, drivers must complete our verification process, which may include document verification and other checks as provided by the Service.
3.4. User Responsibilities
You agree to:
- provide truthful information and update it as needed
- use the Service in compliance with applicable laws and regulations
- communicate with other users courteously and respectfully
- report safety concerns or inappropriate behavior
- maintain appropriate insurance (for drivers)
4. Prohibited Activities
You agree not to engage in the following activities:
- using the Service for illegal purposes or in violation of laws
- harassing, threatening, or harming other users
- providing false or misleading information
- impersonating another person or entity
- circumventing payment or subscription mechanisms
- interfering with the operation of the Service, servers, or network
- collecting or "scraping" data from other users without permission
- using automated means to access the Service without authorization
- offering or accepting rides outside the RideSafe platform
- using the Service to transport illegal goods or substances
5. Payments and Subscriptions
5.1. Subscription Plans
RideSafe offers subscription plans for passengers and drivers. Payment is made monthly or annually, depending on the selected plan. All prices are displayed in the app and may change with prior notice.
5.2. Payment Processing
Payments are processed through secure third-party payment providers. You agree to provide accurate payment information and authorize us to charge your payment method for subscription fees.
5.3. Ride Payments
RideSafe does not facilitate, guarantee, or mediate ride payments. Any disputes related to ride payments are handled solely between users.
5.4. Auto-Renewal
Subscriptions automatically renew unless cancelled before the next billing date. You can cancel your subscription at any time in your account settings.
6. Cancellation and Refunds
6.1. Subscription Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. Premium features remain available until that time.
6.2. Refunds
Subscription fees are generally non-refundable. In exceptional cases, we may provide refunds at our sole discretion. Refund requests must be submitted within 14 days of the charge.
6.3. Ride Cancellations
Cancellation policies for specific rides are set by drivers and displayed in the app. Frequent cancellations may result in account restrictions.
7. Intellectual Property
The Service, including its content, features, and design, is owned by RideSafe and is protected under the laws of Ukraine, as well as applicable international intellectual property treaties.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIDESAFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES (DIRECTLY OR INDIRECTLY), LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
RideSafe is a platform that connects users. We are not responsible for the conduct of users, the condition of vehicles, or the safety of rides. Users are solely responsible for their interactions with each other and for their own safety.
9. Dispute Resolution
9.1. Informal Resolution
If you have a dispute with another user or with RideSafe, we encourage you to contact us first to attempt to resolve the situation informally.
9.2. Governing Law
These Terms are governed by and construed in accordance with the laws of Ukraine.
9.3. Court Jurisdiction
If a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the competent courts of Ukraine in accordance with the laws of Ukraine.
10. Termination
We may terminate or suspend your access to the Service and account immediately, without prior notice, including in case of breach of these Terms.
Upon termination, your right to use the Service will cease. You may also close your account at any time in your settings or by contacting us.
11. Changes to Terms
We may modify these Terms at any time. We will notify users of material changes by posting the updated version on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
